Service Usage Terms

This Agreement defines the terms of use of the PokerADM website (pokeradm.app), related services, the user account, the escrow function and customer support.

Please read this Agreement carefully before using the site. By using the site, creating an account, submitting a request, clicking "Accept", "Sign in", "Create deal", "Buy", "Sell" or taking any other action on the site, you confirm that you have read, understood and accepted the terms of this Agreement.

If you disagree with any of the terms — stop using the site immediately.

Definitions

PokerADMAn independent information & technology service that handles transactions with virtual chips in social poker apps.

SiteThe PokerADM website at pokeradm.app, all of its sections, pages, forms, features and services.

UserAny person visiting the site, registering, creating requests, taking part in transactions or otherwise using the service.

Virtual chipsConventional in-game units in third-party apps (PPPoker, X-Poker, PokerBros and similar).

TransactionA user operation involving the purchase, sale or transfer of virtual chips between users.

EscrowPokerADM's function of handling a transaction in order to reduce the risk of one party failing to perform.

Third-party appsSocial poker apps, platforms and clubs that are not owned or operated by PokerADM.

Status of PokerADM

PokerADM is not a casino, bookmaker, poker operator, organizer of gambling, payment system, bank, financial institution or money-transfer operator.

PokerADM does not organize poker games, tournaments, bets or wagers; it does not accept bets, manage gameplay, determine game results or take part in distribution of winnings.

The service provides technical and information infrastructure for handling user transactions and may act as an independent escrow between the parties to a transaction.

Independence from apps

PokerADM is not the owner, operator, representative, agent, partner, dealer or affiliate of PPPoker, X-Poker, PokerBros or any other social poker apps unless explicitly stated on the site.

All app names, trademarks and logos belong to their respective owners and are used solely for identification.

PokerADM does not control the operation of third-party apps, their rules, infrastructure, accounts, clubs, balances, transfers, blocks or decisions of their administration.

Age restriction

The service is intended only for persons 18 years or older, or any other minimum age set by the laws of the user's country.

By using the site, the user confirms that:

they are at least 18 years old;
they have full legal capacity;
they are entitled to accept this Agreement;
using PokerADM is not prohibited by the laws of their country.

PokerADM may request confirmation of age, identity and country of residence.

Jurisdictional restrictions

The user may not use PokerADM if, in their country, region or other jurisdiction, operations with virtual chips, intermediation or escrow services are prohibited or require a special license.

The user is solely responsible for verifying the legality of using the service in their jurisdiction.

PokerADM may refuse service, restrict access or suspend a transaction in the presence of risky-jurisdiction indicators.

Operations with chips

The user accepts that virtual chips:

are not issued by and do not belong to PokerADM;
reside inside third-party apps;
may be restricted by app rules;
may be cancelled or blocked by app administration;
may be unavailable due to technical failures or actions of third parties.

PokerADM does not guarantee permanent availability, integrity, liquidity, value, transfer, refund or future resale of chips.

Third-party app rules

The purchase, sale, transfer or exchange of virtual chips may be prohibited or restricted by the rules of PPPoker, X-Poker, PokerBros and other third-party apps.

The user is solely required to review the rules of the corresponding app prior to a transaction. PokerADM bears no responsibility for consequences of the user breaching app rules, including:

blocking or deletion of the account;
cancellation of chips;
refusal of the app to recognize a chip transfer;
restriction of access to a club;
inability to use chips further;
other sanctions from the third-party app.

PokerADM as escrow

When handling a transaction, PokerADM may act as an independent escrow. The specific transaction process, deadlines, fees and grounds for cancellation are set out on the site, in the transaction card or escrow rules.

The escrow function does not mean that PokerADM is a party to the game, organizes gambling, accepts bets, guarantees profit, growth in chip value or absence of blocks by third-party apps.

PokerADM may refuse to handle a transaction without explanation when there is suspicion or violation of the rules.

Transaction process

The user must provide accurate, up-to-date and complete information: nickname, account ID, club ID, app name, chip amount, payment details, contacts and other information.

PokerADM bears no responsibility for losses arising from user errors in the data provided.

A transaction is considered complete after the conditions specified in the transaction card or confirmed by the parties via the PokerADM interface or support service have been met.

Fees and payments

PokerADM may charge a fee for handling a transaction, escrow services, request processing, support or other services listed on the site. The amount is shown before transaction confirmation.

The PokerADM fee is not a bet, deposit, winnings or fee for taking part in a game.

PokerADM may change the amount of fees and the terms of service. New terms apply to transactions created after publication of the changes.

Refunds, cancellations and disputes

Refund, cancellation or suspension of a transaction is possible only in the cases provided for by the Agreement, escrow rules or a decision of PokerADM. The service may temporarily suspend a transaction if:

one of the parties has not met the terms of the transaction;
a complaint has been received from a user;
a dispute has arisen over the fact of chip transfer or payment;
signs of fraud have been detected;
the user has provided inaccurate information;
there is suspicion of a violation of law or third-party rights;
additional verification is required.

When considering a dispute, PokerADM may request evidence: screenshots, videos, correspondence, transaction IDs, account data, payment confirmation. A decision is made based on the available evidence and service rules.

User verification (AML/KYC)

PokerADM may verify users, transactions and sources of funds in order to prevent fraud, money laundering and other violations.

The service may request:

an identity document;
confirmation of age and country of residence;
confirmation of the source of funds;
confirmation of account ownership;
additional information for risk assessment.

Refusal to undergo verification may be grounds for suspension of a transaction and restriction of access.

Prohibited use

It is prohibited to use PokerADM:

for taking part in illegal gambling;
to circumvent the laws of one's country;
to bypass blocks or restrictions of apps;
for fraud and money laundering;
to sell stolen or disputed chips;
for operations on behalf of third parties without basis;
to use other people's accounts and payment details;
for abuse of disputes and chargeback procedures;
for using bots, scripts and exploiting vulnerabilities.

No profit guarantee

PokerADM does not guarantee the user any income, winnings, profit, ability to resell chips, stable value, presence of buyers or sellers, absence of blocks, successful completion of transactions, availability of third-party apps or that their rules will not change.

Any operations with virtual chips are performed by the user voluntarily and at their own risk.

User responsibility

The user bears full responsibility for:

compliance with the laws of their country;
compliance with third-party app rules;
accuracy of the data provided;
legality of the origin of funds and chips;
tax obligations;
actions performed via their account;
safekeeping of login, password and access credentials.

The user undertakes to compensate PokerADM for losses, claims and other damages arising from a breach of the Agreement or law.

Limitation of liability

To the maximum extent permitted by law, PokerADM bears no responsibility for:

actions or omissions of third-party apps;
blocking of accounts and cancellation of chips;
technical failures of third-party apps;
errors, delays or unavailability of the site;
actions of banks, exchange and payment services;
actions of other users;
tax consequences of transactions;
lost profit and indirect losses.

The service's liability is limited to the fee actually received under the specific disputed transaction.

User account

To access certain site functions, the user may be required to create an account and keep their data up to date.

The user is responsible for safekeeping login data and for all actions taken via their account.

PokerADM may block, restrict or delete an account in case of breach of the Agreement, law, third-party rights or increased risk.

Intellectual property

All elements of the PokerADM site — texts, design, interface, logos, graphics, source code, databases and structure — belong to PokerADM or are used on a lawful basis.

The user may not copy, distribute, modify, sell or publish site materials without written consent of PokerADM.

The names PPPoker, X-Poker, PokerBros and other third-party apps belong to their respective owners.

Personal data

By using the site, the user agrees to the processing of personal data in accordance with PokerADM's Privacy Policy.

Data is processed for registration, communication with the user, handling of transactions, identity verification, prevention of fraud and compliance with law.

The detailed procedure is set by the Privacy Policy published on the site.

Taxes

The user is solely responsible for determining, declaring and paying any taxes, duties and fees related to the use of PokerADM or participation in transactions.

PokerADM does not provide tax advice and bears no responsibility for the user's tax obligations.

Changes to terms

PokerADM may at any time change the Agreement, service rules, fees, transaction process and other terms.

The new edition takes effect upon publication on the site, unless another date is specified.

Continued use of the site after publication of changes constitutes the user's consent to the new edition.

Suspension of access

PokerADM may temporarily or permanently restrict the user's access to the site without prior notice if:

the user breaches the Agreement or law;
the user provides inaccurate information;
the user refuses verification;
a transaction shows signs of fraud;
the user's actions create risk for the service or other users;
required by law, a payment partner, rights holder or government body.

Disputes with PokerADM

The user undertakes to first send a claim to PokerADM customer support via the contacts indicated on the site.

PokerADM reviews requests within a reasonable time, taking into account the complexity of the situation and the volume of evidence.

If the dispute is not resolved through negotiations, it is subject to consideration in the manner provided by the applicable law and the jurisdiction specified in section 24.

Governing law and jurisdiction

This Agreement and any relations between the User and PokerADM are governed by and construed in accordance with the laws of Curaçao.

Any disputes, claims, demands or disagreements are subject to exclusive consideration in the competent courts of Curaçao, including the courts in Willemstad, unless otherwise provided by mandatory rules of applicable law.

The User irrevocably consents to the personal jurisdiction of the courts of Curaçao and waives any objections regarding venue and place of dispute resolution.

The choice of Curaçao law does not relieve the User of the obligation to comply with the laws of the country of their citizenship, residence and actual location, as well as the rules of third-party apps and payment services.

If the laws of the User's country prohibit or restrict operations with virtual chips or require a special license — the User may not use PokerADM.

If any provision of the Agreement is held invalid by a competent court, it is to be interpreted to the minimum extent necessary to maintain legal force; the remaining provisions remain fully in force.

Before going to court, the User undertakes to send PokerADM a written claim. The parties make reasonable efforts for pre-trial settlement within 30 calendar days from the date of receipt of the claim.

The User agrees that they may not initiate class actions or group proceedings against PokerADM, where such waiver is permitted by law. Any claims are considered solely on an individual basis.

Acceptance of terms

By using PokerADM, the user confirms that they:

have read and understood this Agreement;
are at least 18 years old;
use the site voluntarily;
understand the risks of operations with virtual chips;
understand that such operations may be prohibited by the rules of third-party apps;
have independently verified the legality of using the service in their country;
do not consider PokerADM a casino, poker operator, bookmaker or payment system;
accept all risks of using the site and participating in transactions.
